DESERT HOT SPRINGS, CA – The city is now facing a second lawsuit filed by a police officer. This time by a veteran officer and former president of the Police Officers Association. The complaint by Paul Tapia was served on city management but kept from public view. It’s unclear if the city council is aware of pending action served to the city clerk on November 15, 2012.

Tapia alleges much of the same complaints as another action facing the city, that of former DHS police officer Andrea Heath who filed a $5 million lawsuit against the city naming city officials, including City Manager Rick Daniels and former Police Chief Patrick Williams.

Both Tapia and Heath claim city mismanagement played politics with their lives, politics that ultimately led to both being fired.

Toy Drive Conflicted

Tapia first butted heads with City Manager Rick Daniels over a POA toy give-away last Christmas 2011 that played out in the media. Tapia was highly critical of Daniels as it appears the city manager did everything possible to deny use of a city building for the toy drive.

At the same time, the city and the POA were in heated contract negotiations.

Desert Vortex is the first to report the pending action by Tapia. In the Heath matter, news of her claim went national because it involved a conviction of excessive use of force by a Desert Hot Springs police officer at the center of her complaint. Heath was cooperating with federal authorities in that investigation at the time of her dismissal.

The city is already defending itself against the $5 million lawsuit by officer Heath and that case is now winding through the courts. This Tapia suit for an undisclosed amount of damages is just starting down the legal path and suggests another bumpy public relations ride ahead for the city.

Paul Tapia has been a police officer for the Desert Hot Springs Police Department (PD) for four years and prior to joining DHSPD had a twelve-year law enforcement career that followed twenty-two years of military service in the United States Navy.

Tapia was unanimously elected as President of the Desert Hot Springs POA in October of 2011. Prior to taking that position, Paul Tapia had a flawless career having never received a negative performance observation report. Tapia received twenty-four career commendations and other recognitions from private groups as an in the communities where he served. Tapia received not less than “meets standards” or”exceeds standards” on yearly evaluations.

It was no accident Paul Tapia was elected president of the POA. Tapia was respected as a stand-up guy, a no-nonsense person that the officers wanted to represent them in the contract negotiations. Ass kissing was never Tapia’s style but no one suspected his representing the officers union in contract negotiations would end his career.

The POA and the city were stuck in negotiations for four months when Tapia was elected POA president. Right off the bat Tapia began to be challenged by Rick Daniels who, says Tapia, refused the use of the Senior Center by the POA for an annual Christmas toy giveaway. Daniels said NO.

This disagreement went public in the media with print, radio, and television broadcasts. It was inferred that Tapia and his officers were greedy. Daniels was portrayed as the Grinch.

In December of 2011, Paul Tapia attended a City Council meeting to speak about the on-going contract negotiations between the POA and the City. That gave Daniels an opportunity to attack the officer. City Manager Rick Daniels accused Tapia of going public with negotiations Daniels said were supposed to be conducted quietly.

At the same time, Daniels appeared on television to discuss the contract himself, telling a television viewing audience that the POA was unwilling to compromise on the issue of pension contributions. Tapia countered that the POA was willing to offer up pension concessions, which the officers ultimately did.

Daniels was not able to cast his spin on the story as he had hoped. Police officers in Desert Hot Springs enjoy widespread support in the community.

At this same time, Tapia was in line for a promotion to sergeant but when he inquired about the promotion status he said he received no information. Tapia was seeking information relating to three previous sergeant promotions.

The response went nowhere and so did Tapia’s promotion. City Manager Rick Daniels simply denied Paul Tapia’s request.

The city manager then turned up the volume of his criticism of Tapia for having used the media and used the city to heap punishment upon the POA president.

Rising Up to Career Downfall

Adding to Daniels’ frustration, moral of the PD the officers was in a free fall. An independent survey of PD officers showed a low appraisal of the police command structure. Frustration festered due to the department’s promotion practices according to the survey results.

Police Chief Williams interpreted the media release as an assault upon the department and the chief demanded Tapia “answer” about that vote of no confidence. That same day Williams released a statement to the media decrying the “tactics” of the POA and “certain members” in particular.

Denied Sergeant Position And Denied Shift Change

Days later, Paul Tapia was informed he was not selected for the open sergeant position. Tapia then requested a shift exchange, a request routinely granted by the Department. This too was denied – with no explanation.

In January of 2012, Paul Tapia wrote to Police Chief Pat Williams regarding improper sergeant promotion practices and addressed contract violations, reporting this to members of the city council. The next day, Daniels ordered Tapia to stop all communications with the city regarding Williams’ violations.

On this same day, Paul Tapia filed two grievances on behalf of the POA regarding unfair promotions and improper shift selections. Immediately after, Tapia was informed by members of the public that Daniels was making various and numerous negative comments about him. Tapia was warned to “watch his back,” because Daniels had made it clear to certain individuals that he was going to “go after” Tapia and “make life hell” for him.

Only a few days after this warning, Tapia was informed that his 2011 yearly evaluation was completed by his immediate supervisor and was in the hands of Williams and Daniels awaiting approval. It was kept secret from Tapia, something he claims is a violation of contract and labor laws.

[To this day, Tapia says he has not received an approved evaluation; some eleven months after its submission. All other officers' 2011 evaluations have been completed and approved, most within weeks of supervisors' submissions.]

Paul Tapia has asked numerous times for an update on the evaluation’s approval. Each request has been met with little to no explanation. Tapia has been told by those within the PD that Police Chief Pat Williams and City Manager Rick Daniels intended to adversely downgrade his evaluation purely for retaliatory reasons. By withholding Paul Tapia’s evaluation, Tapia is left boxing with shadows as the city has all the power with the officer ending up losing his job.

In late January of 2012, while on duty, Paul Tapia was called into City Hall where he was told it was necessary for him to sign the still-being-negotiated POA contract immediately on the spot. After nearly three hours of badgering and coercion, Tapia eventually relented and signed the contract. But city hall was not done with Tapia just yet.

The very next day, Tapia was served with notice of intent to suspend for thirty days, one of the most severe forms of punishment an officer can receive short of dismissal. In the end, he was was fired from his job before the 30 day suspension was completed.

City Manager Rick Daniels joined Police Chief Pat Williams in whining to the officers that “certain” members of the POA were disruptively using the media as a union tactic waging a media battle” even though for weeks Daniels had been waging a media campaign to discredit Tapia and the POA. When the POA used the same technique, Daniels characterized them as waging a media battle.

Tapia Continues to be Punished

In response to the officer survey, Commander [now police chief] Kate Singer told Tapia that she and city administration “were not happy” about the vote-of-no-confidence in the survey and that it had been provide to the media. Tapia says he was later told by a city official that Daniels had been openly saying the city was going to “get rid of Tapia” and heard that management was looking for “dirt” on him.

In February Paul Tapia received a letter from Police Chief Williams that Tapia was “no longer an employee of the city” and not to “represent yourself as a police officer.” Later the chief retracted the statement leaving Tapia officially still a city employee. However he has not been paid since February 7, 2012, the day he was hauled off in an ambulance to Desert Regional from a meeting with chief Williams.

During the meeting the chief walked out on Tapia and his attorney. After three days in the hospital Tapia has remained on medical leave for past work related injuries sustained on the job including fractured ankle, fractured ribs, fractured back. That these injuries were sustained on the job is not in dispute.

During that same meeting a group of angry local citizens gathered on the streets supporting the Desert Hot Springs Police. The initial six were joined by dozens more that were insultingly characterized by police management as “felons” and misleadingly dismissed as people bused in from out of the city.

Adding to Paul Tapia’s list, he now suffers from extreme high blood pressure as a direct result of being on the receiving end of hostile actions against the officer by Williams and Daniels resulting from Tapia doing his job as POA President.

Finally in May 2012, while still out on medical disability, the city totally pulled the rug out from Paul Tapia by stripping him of his peace officer powers. Tapia’s repeated requests for an explanation have received conflicting answers.

City Manager Rick Daniels has also refused to schedule hearings to provide Paul Tapia an opportunity to rebut retaliatory disciplinary action taken against him. Tapia said Daniels continues to punishing him by ignoring his work comp injury claim.

First Amendment Violations

With the new year it will be impossible to ignore Paul Tapia. His complaint alleges that actions against him were retaliatory and violated his First Amendment rights of free speech and union representation. The litigation involves Daniels, Williams, Singer and the city. It seeks unspecified damages for violations of the Constitution plus federal and state laws and labor codes.

Tapia is seeking recovery of all unlawfully withheld wages and benefits plus damages and costs.

    Paul Tapia did the same thing when he worked at Huntington Park. He resigned, sued and lost. He worked at Colton PD and was doing the same there. He was disliked by everyone of his co workers and had to leave or be fired from that job when his friend(Chief of Police at Colton) was also fired.

    Hello all. I believe Steve hit it right on the spot. Who else would want to put out negative info on officer Tapia, Williams, Singer, or maybe even Peary, bottom line, somebody in administration or sucking up to administration to save their job or get promoted. Lets give this so call John an update on his misinformation. It seems he cant read since John has forgotten a few items of concerns to the public. For example, there is a pattern with this police administration, take a look at the past three association president’s, they have all been forced out by Williams and Daniels. Officer Rex sued, he settled and retired. Officer O’Connor sued, he settled and retired. So now we have a third association president out on medical leave and is now suing, but why. How about Officer Heath, why is she sueing as well. Maybe she was fired for reporting corruption as well. Read her lawsuit John, oh, I forgot, you cant read. John, maybe you need to do your homework or at least learn to research before you let BS come out of it. Lets see, according to the upcoming lawsuit, maybe officer Tapia was trying to stop corruption and report misconduct when this administration retaliated against him by suspending him for 30 days. I hear the retaliation suspension was on his own complaint that he filed with EEOC. How dirty is that. Maybe someone can explain why everyone is starting to bail, is the kitchen getting hot or is someone about to get their hands caught in the cookie jar. Why is it that EEOC is now investigating the city for retaliating against officer Tapia. Again, maybe because he was doing the right thing and reporting corruption and misconduct. Maybe that is why Pat Williams put officer Tapia in the hospital after standing up to this administration that has ignored labor laws and treated this police association as a disfunctional organization since Pat Williams was hired. As for Huntington Park, according to 9th circuit court of appeals case regarding Tapia, he was reporting corruption and misconduct as well. After doing my homework, it appears the asst chief at HP was fired for 14 counts of misconduct, the chief was arrested in Anaheim for lewd conduct, and the vice mayor Nogez is sitting in the L.A. County jail for 46 counts of fraud. What can you say about that John. Officer Tapia did not lose the case, it was thrown out during summary judgement for a technicality, but how would you know that John if you cant read. If I had to guess, with all the corruption in Bell and Huntington Park, 9th circuit might just rule in favor of Officer Tapia in the coming weeks. So your wrong again John. As for Colton PD and DHSPD, according to officer Tapia’s evaluations, they are all outstanding and no one had an issue with him, with the exception of those involved in supporting corruption, misconduct, and abusing their positions for their own legacy. As for Chief Rulon, I believe the papers said something about reporting the city manager to the FEDS for fraud, than the city manager fired him in retaliation. It appears the city manager was covering up credit card fraud for personal use by his buddy councilman Hernandez, who got convicted for using the city credit card to rent hotel rooms for prostiution. I guess your wrong again John, still cant read. I called HP and all the brass their said he was a great cop. I think HP is about to get a rude awakening with 9th circuit. I called Colton and they too said Tapia was a great cop, his personal relationship with Chief Rulon had no baring on his performance, maybe that is why his evaluations are outstanding. As a matter a fact, all his evaluations are outstanding at every department he has served. So where did you get your BS information Mr. John. Next time do your howework and speak the truth, that is if you have the guts to come out of the closet. Just like Steve said, how dare you attempt to smear the name of a great officer with 15 years of exemplary law enforcement service, to include officer of the year in Anaheim. How about his 20 years of honorable service as a high ranking NCO in the Navy. A decorated veteran who believes in one thing, honor, integrity, and values, something the DHSPD adminstration lacks. By the way John, I guess you forgot about the vote of no confidence when 17 officer surveys were completed on Pat Williams and his administration, which resulted in slamming all of them for integrity, ethics and trust. Maybe John thinks that was all made up too. By the way John, any idea why this administration is holding out on officer Tapia’s evaluations from 2011. I’m sure its an oversight, or maybe just more retaliation on trying to smear this officer further with negative information, just like yours. How is it possible that this officer has all this experience, to include a near completed Masters Degree, and yet he has been passed over three times for Sergeant. Maybe he needs to get fired from Indio for Fraud, just like Chief Ramos. How do you hire someone to be a Sergeant at DHSPD who was just fired from Indio for fruad. Maybe you have to be involved in corruption or be part of the click, but that is just my guess. John, next time you want to start thowing out some of officer Tapia’s personal information out there, why dont you learn about integrity and ethics, something you probably dont know about based on your BS comments.
